Director’s Rights and Use of Work
Under Lebanese Law No. 75/1999 on the Protection of Literary and Artistic Property, directors of audiovisual works, including films, music videos, and other visual media, are granted both moral rights and economic rights over their creations.
Moral Rights
As outlined in Article 15 of the law, directors retain the inalienable moral rights to:
- Attribution: Be recognized as the creator of the work.
- Integrity: Object to any distortion, modification, or derogatory action that could harm their reputation or the integrity of the work.
- Public Presentation: Use their works for exhibitions, showcases, or other forms of presentation unless explicitly restricted by a contractual agreement.
These rights are perpetual, non-transferable, and cannot be waived, even if the economic rights have been transferred to a third party.
Economic Rights
According to Article 16, directors are entitled to economic rights, allowing them to financially benefit from their works, including:
- Reproduction and Distribution: Permission to reproduce or share their work across platforms, including online and social media, for commercial or promotional purposes.
- Public Performance: The right to broadcast or make the work available to the public through any medium.
- Derivative Works: The ability to create derivative works, adaptations, or edits for promotional or financial purposes.
These rights, unless otherwise stipulated by contractual agreements, remain with the director, even if ownership of the work is transferred to a producer or third party.
Applicability
Jean-Claude Dib retains the right to:
- Repost or share directed projects in full or in part across online platforms and social media for promotional or monetization purposes.
- Use the works in professional portfolios, advertising, or collaborations, provided such use does not violate any specific contractual obligations.
Any restrictions or modifications to these rights must be clearly outlined in a mutually agreed-upon written contract.
